Cyber Insurance Assessment Contest Official Rules

No purchase necessary to enter or win.

1. Contest Timing

The Insurance Bureau of Canada Cyber Insurance Assessment Contest (the “Contest”) begins on Tuesday, October 1, 2024 at 10 a.m. Eastern Time (“ET”) and ends on Thursday, October 31, 2024 at 11:59:59 p.m. ET (the “Contest Period”). The Contest Period will consist of four prize periods (each a “Prize Period”) as follows:

Entry in the Contest does not constitute entry into any other promotion or contest.

2. Sponsor

By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules (the “Official Rules”) and the decisions of the Contest sponsor Insurance Bureau of Canada (the “Sponsor”), whose decisions shall be final and legally binding in all respects. 

3. Eligibility

The Contest is open to residents of Canada (excluding Quebec) who are over the age of majority in their province/territory of residence, except employees, officers, and directors of Sponsor, Paradigm Public Relations, and their respective affiliated companies, subsidiaries, and companies engaged in the development, production or distribution of Contest materials (collectively, the “Contest Entities”). The immediate family members (spouse, parents, grandparents, siblings, children and grandchildren) and/or people living in the same household (whether or not related) of excluded employees, officers and directors are not eligible to participate in the Contest.

4. How to Enter

NO PURCHASE NECESSARY. To enter the Contest, visit cybersavvycanada.ca (the “Website”) during the Contest Period and complete all 10 questions that are part of Insurance Bureau of Canada’s Cyber Insurance Assessment. Then, fully complete the registration form on the Website, including your full name and email address and agreeing to the eligibility and full contest rules. Once a completed entry is submitted via the Website, it will be eligible for each random draw subsequent to the date of submission, subject to the Official Rules.

To obtain a Contest entry without completing the Cyber Insurance Assessment, eligible individuals may instead hand print their full name (first, last and middle initial(s)), their complete mailing address (including postal code), and email address on a plain piece of paper and mail it in a sealed postage prepaid envelope (with sufficient postage) to: The Insurance Bureau of Canada Cyber Insurance Assessment Contest; c/o Paradigm Public relations, 121 Bloor Street East, Suite 520, Toronto, Ontario, M4W 3M5. A properly-completed mail-in entry will result in one (1) entry in each random draw subsequent to the receipt of the entry at the above address, subject to these Official Rules (to be eligible for any draw, the entry must be received at the above address by no later than 5:00 p.m. ET on the day immediately preceding the applicable Prize Period Draw Date (see Rules 1 and 6)). Incomplete and/or illegible entries are ineligible. No photocopied, computer-generated facsimiles, mechanically reproduced, bulk or mass entries permitted.

Entry Limit: There is a limit of one (1) entry per person and per email address in the Contest (regardless of the method of entry).

Use of Data. Sponsor will be collecting personal data about the entrants online, in accordance with its  privacy policy available at: https://cybersavvycanada.com/privacy-policy/. By participating in the Contest, each entrant hereby agrees to Sponsor’s collection and usage of their personal information for the purposes of administering this Contest and in accordance with Sponsor’s privacy policy. The preceding sentence does not limit any other consent(s) that an individual may separately provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

NOTE: For greater certainty and avoidance of any doubt, you can only use one (1) email address to participate in the Contest. If it is discovered that you attempted to enter more than once during the Contest Period, then all your Entries will be void. Use of any automated system including but not limited to commercial sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified for this Contest. Tampering with the entry process or the operation of the Contest is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an Entry cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible.

5. Prizes/Approximate Retail Value (“ARV”)

The Contest is open to residents of Canada (excluding Quebec) who are over the age of majority in their province/territory of residence, except employees, officers, and directors of Sponsor, Paradigm Public Relations, and their respective affiliated companies, subsidiaries, and companies engaged in the development, production or distribution of Contest materials (collectively, the “Contest Entities”). The immediate family members (spouse, parents, grandparents, siblings, children and grandchildren) and/or people living in the same household (whether or not related) of excluded employees, officers and directors are not eligible to participate in the Contest.

6. Winner Selection and Notification

Random draws will be conducted on each of the Prize Period Draw Dates shown in Rule 1 above, between 10 a.m. and 2 p.m. ET in Toronto, Ontario from all eligible Entries received during the applicable Prize Period as well as all eligible entries received in previous Prize Periods. There is a limit of one (1) Prize per person and per email address in the Contest. The odds of winning a Prize will depend on the total number of eligible entries received for each draw.

The Sponsor or its designated representative will make three (3) attempts to contact each potential Prize winner by email (using the information provided at the time of entry) within ten (10) business days of the applicable Prize Period Draw Date.  If the selected entrant cannot be contacted within three (3) attempts or ten (10) business days of the Prize Period Draw Date (whichever occurs first), or there is a return of any notification as undeliverable, then the selected entrant will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries from the same pool of entrants (in which case the forgoing provisions of this section shall apply to such new selected entrant). 

Before being declared a Prize winner, each selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within ten (10) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Official Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties, and each of their respective officers, directors, employees, owners, representatives, agents, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of the selected entrant’s name, city, province, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the internet. If a selected Prize winner: (a) fails to correctly answer the skill-testing question; and/or (b) fails to return the properly executed Contest documents within the specified time, then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries from that same pool of entrants (in which case the forgoing provisions of this section shall apply to such new selected entrant).  Upon successfully meeting these requirements, the winner will receive the Prize via e-mail.

If a potential Prize winner: (a) cannot accept (or is unwilling to accept) the Prize as awarded for any reason; and/or (b) is determined to be in violation of these Official Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to select an alternate eligible entrant from among the remaining eligible entries from that same pool of entrants (in which case the forgoing provisions of this section shall apply to such new selected entrant).

7. General Prize Restrictions/Conditions

Entrants agree that Released Parties: (a) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Contest or any Contest-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (b) have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor makes no warranties, and disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Contest.  WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

8. Publicity Release

Acceptance of any prize shall constitute the winner’s agreement and consent to Sponsor and its designees to use the winner’s name, city, province, voice, likeness, photo, avatar, statements about the Contest and/or prize information in connection with this Contest (collectively, the “Attributes“), without compensation for any promotional, advertising or other purposes, in any manner the Sponsor deems fit. The winner grants the Sponsor a perpetual, worldwide, royalty-free, license to use the Attributes in any and all media now known or hereafter devised, including the Internet, without limitation and without further compensation, notification, permission or other consideration, (except where prohibited by law), and releases the Released Parties from all claims arising out of the use of such Attributes. 

9. Release of Liability / Conditions of Participation

  1. Transmission of Information. By entering this Contest, each entrant agrees to release and hold harmless the Released Parties. Each entrant agrees and acknowledges that the Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, production, typographical or other errors or by any of the equipment or programming associated with or utilized in this Contest; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or this Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Contest, the uploading, the processing or random selection of entries, the announcement of the prize or in any Contest -related materials; (5) late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or mail; (6) costs associated with claiming or redeeming the prize; nor (7) loss or damages resulting from an entrant’s connection to the internet via any of the websites contained herein. Released Parties are not responsible for any incorrect, mis-transcribed, misdirected or undeliverable entries, e-mail transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor assumes no responsibility for late, lost, incomplete, inaccurate or damaged entries, or undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or e-mail client or for insufficient space in user’s e-mail account to receive e-mail.  Sponsor does not accept responsibility for any damage (whether material or non-material) caused to entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor.
  2. Reservation of Rights. Sponsor reserves the right to cancel, suspend, and/or modify this Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of this Contest, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible entries received up to time of such action or as otherwise deemed fair and appropriate by Sponsor. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of this Contest, gains unauthorized access to accounts, or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. The preceding in no way precludes Sponsor from taking other actions against such individuals so as to protect its rights. Sponsor’s failure to enforce any provision of these Official Rules in a given circumstance does not constitute the waiver of such provision.
  3. Release and Indemnity. By participating, each entrant indemnifies, releases and agrees to hold harmless the Released Parties from any and all liability for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, arising from participating in the Contest, any Contest-related activity and/or acceptance, receipt, possession or use/misuse of any Prize and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery.
  4. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE CONTEST WEBSITE AND/OR PARTICIPATING IN THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE CONTEST. WITHOUT LIMITING THE FOREGOING, THIS CONTEST AND THE PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

10. Governing Law / Jurisdiction

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the province of Ontario, and the laws of Canada applicable therein without giving effect to any choice of law or conflict of law rules (whether of the province of Ontario or any other jurisdiction). The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
